These Terms and Conditions of Rental (“Terms”) govern all vehicle rental agreements entered into between Safariway Rentals (“we”, “us”) and the customer (“you”, “renter”). By making a booking or collecting a vehicle, you agree to be bound by these Terms. These Terms comply with the Australian Consumer Law (ACL) and the AFIA Car Rental Code of Practice.
1. Definitions
  • Authorised Driver — the renter and any additional driver named on the Rental Agreement.
  • Claims Management Fee — the administrative fee charged to manage a damage or loss claim, regardless of fault.
  • Damage — any loss or deterioration to the vehicle not attributable to fair wear and tear.
  • Electric Vehicle (EV) — any vehicle powered wholly or partly by an electric motor, including hybrids.
  • Excess Amount — the maximum you are liable to pay for damage or loss in any single incident (see Clause 15).
  • Fair Wear and Tear — minor superficial deterioration from ordinary, careful use per the AFIA Code of Practice.
  • Force Majeure Event — an event beyond our reasonable control (natural disasters, floods, bushfires, pandemic, government orders, war).
  • One-Way Rental — a rental where the vehicle is collected from one location and returned to a different approved location.
  • Rental Agreement — the binding contract comprising the Rental Document, these Terms, and any booking confirmation.
  • Rental Period — the period from vehicle collection until physically returned and inspected by staff.
  • Security Bond — funds pre-authorised on your payment card at pick-up as security against outstanding amounts.
  • Vehicle — the motor vehicle specified in the Rental Agreement and any accessories provided with it.
2. Formation of the Rental Agreement
A binding Rental Agreement is formed when: (a) you complete an online booking and receive confirmation; or (b) you sign a Rental Agreement at vehicle collection — whichever occurs first. If you do not collect the vehicle within one (1) hour of the agreed pick-up time without prior notice, Safariway Rentals is no longer bound by the reservation.
⚠️ Important: Do not sign the Rental Agreement unless you have read and understood these Terms in full.
3. Eligibility and Driver Requirements

3.1 Minimum Age

The minimum age to rent is 21 years. Renters aged 21–24 are classified as Young Drivers and are subject to a daily surcharge and increased excess amounts (see Clause 15).

3.2 Driver’s Licence

All drivers must hold a current, valid, full driver’s licence (not provisional or learner) held for a minimum of one (1) year. Overseas licences not in English must be accompanied by an IDP or certified English translation. Digital licences are accepted subject to staff verification.

3.3 International Renters

Must present: (a) valid overseas licence; (b) IDP if not in English; (c) valid passport; (d) proof of Australian address.

3.4 Additional Drivers

Additional drivers may be added at pick-up for $10/day (capped at $50). All must be present at pick-up, meet the same eligibility requirements, and be named on the Rental Agreement. No cover applies to unlisted drivers.

3.5 Maximum Age

No maximum age restriction. Renters over 75 may be asked to provide a medical certificate confirming fitness to drive.
4. Bookings and Reservations

4.1 Making a Booking

Bookings may be made at safariwayrentals.au, by phone on 0405 630 231, or by email. Reservations are for vehicle categories, not specific makes or models. If unavailable, we will offer a comparable upgrade at no extra charge, or a full refund.

4.2 Prepaid Bookings

If a prepaid rate is selected, the full rental amount is charged at time of booking. If the vehicle is not collected, rental charges are forfeited unless Safariway Rentals has failed to provide the booked category.
5. Cancellation and Modification Policy

5.1 Cancellations by You

Transaction fees are non-refundable in all cases. Cancellations via the booking portal or by calling 0405 630 231.

5.2 Modifications

Subject to availability and rate differences. Modifications within 24 hours of pick-up incur a $25 fee.

5.3 No-Show

Not collecting by the agreed time without notice = no-show. 100% of total rental cost is forfeited.

5.4 Cancellations by Safariway Rentals

In exceptional circumstances or Force Majeure Events, a full refund will be issued within 5 business days. We are not liable for any consequential losses.
6. Early Return Policy
  • No refund for unused rental days. All rentals are charged based on the pre-agreed period.
  • Contact us at least 4 hours before your new intended return time if you wish to shorten your rental.
  • An Early Return Fee may apply to compensate for lost rental opportunity.
  • The daily rate may be recalculated at a higher short-period rate, potentially increasing the cost per day.
💡 Tip: Call us first before returning early — we may be able to adjust your booking to a better rate.
7. Payment, Charges and Security Bond

7.1 Accepted Payment Methods

Visa, Mastercard, and EFTPOS debit cards. Physical bank-issued card in renter’s name required at pick-up. Prepaid, reloadable, travel money, and gift cards are not accepted. Cash rentals available with full upfront payment plus cash bond.

7.2 Rental Charges

Calculated at the confirmed daily rate. Partial days may be charged as full days. All prices include GST.

7.3 Young Driver Surcharge

Renters aged 21–24: $15/day surcharge (GST inclusive) in addition to rental charges.

7.4 Security Bond

Pre-authorised hold on your payment card at pick-up — a hold, not a charge. Released within 3–10 business days after return.

7.5 Late Payment and Debt Recovery

Interest on overdue amounts accrues at 2.5% per calendar month. Unpaid debts may be referred to a collections agency at your cost.

7.6 Payment Reversals and Chargebacks

Improper or fraudulent chargebacks render you liable for the full reversed amount plus all costs Safariway Rentals incurs in contesting.
8. Pick-Up and Vehicle Collection

8.1 Documents Required

At pick-up: (a) valid driver’s licence (+ IDP if applicable); (b) booking confirmation; (c) payment card in renter’s name; (d) additional drivers’ licences.

8.2 Vehicle Inspection

Joint inspection conducted at pick-up. All existing damage noted on the Vehicle Inspection Report. By signing, you confirm the report accurately reflects the vehicle’s condition. Raise any concerns before signing.

8.3 After-Hours Pick-Up

Available with 24 hours’ notice and full payment in advance. $50 after-hours surcharge applies.
9. During the Rental Period

9.1 Your Responsibilities

Drive safely and lawfully; maintain fuel/fluid levels; secure the vehicle when unattended; report any damage, accident, or theft immediately on 0405 630 231; allow only Authorised Drivers; pay all tolls, parking fees, and fines.

9.2 Extensions

Contact Safariway Rentals at least 4 hours before your scheduled return. Extensions subject to availability. Unauthorised extensions may incur additional charges.

9.3 Interstate and Geographic Restrictions

Interstate travel permitted within SA, VIC, NSW, QLD, and WA on sealed roads only. Unsealed roads and islands (except Kangaroo Island with prior written approval) are prohibited. Notify us of any interstate travel before commencing.

9.4 Weather and Natural Hazard Restrictions

Driving through floodwater is strictly prohibited regardless of depth. Do not drive on roads closed by emergency services or affected by bushfire, landslide, or structural damage. Damage from such use is not covered and you will be fully liable.
10. Permitted and Prohibited Use

10.1 Permitted Use

Lawful purposes on sealed roads by Authorised Drivers, per manufacturer’s specifications.

10.2 Prohibited Use

  • Off-road, unsealed, gravel, or 4WD-only tracks
  • Floodwaters, waterways, tidal areas, beaches, or sand
  • Commercial purposes including ridesharing (Uber, DiDi, Ola, or similar)
  • Towing, pushing, or overloading beyond manufacturer specifications
  • Under influence of alcohol, drugs, or any impairing substance
  • Illegal purposes, racing, speed trials, or stunts
  • Exceeding licensed passenger capacity
  • By unlisted drivers or persons under minimum rental age
  • Outside the permitted geographic area

10.3 Odometer and Vehicle Systems

Tampering with the odometer, GPS, telematics, or any monitoring system renders you fully liable for resulting damage plus unrecorded kilometres.

10.4 Smoking, Vaping and Pets

Strictly prohibited. Animals not permitted without written approval. Breaches: $150–$250 cleaning fee. Service animals permitted with advance notice.

10.5 Effect of Prohibited Use

Voids all cover. You are personally liable for full damage costs, third-party claims, legal costs, loss of use, and any fines. We may terminate the rental immediately (Clause 27).
11. Fuel Policy
Safariway Rentals operates a full-to-full fuel policy.

Misfuelling (wrong fuel type) is not covered. Stop immediately, do not restart the engine, call 0405 630 231. You are liable for all resulting damage and recovery costs.

11.1 Pre-Paid Fuel Option

Pre-paid full tank may be available at pick-up. No refund for unused fuel. Enquire at pick-up.
12. Electric Vehicle Rentals

12.1 Battery and Charging

EVs are provided at a minimum charge level (“Battery Departure Level”) noted on the Vehicle Inspection Report. Return at or above this level. If returned below: electricity cost + $35 EV recharging admin fee.

12.2 Third-Party Charging

All electricity costs are your responsibility. Third-party network charges invoiced to Safariway Rentals will be passed on to you plus a $20 processing fee per invoice.

12.3 Range Management

Running out of charge = at-fault roadside event (see Clause 23). Do not allow battery to reach 0% — irreversible damage may result and you may be fully liable.

12.4 EV Restrictions

Same geographic and road-type restrictions as all vehicles apply. Safariway Rentals provides no warranty on public charging availability.
13. Return of the Vehicle

13.1 Return Procedure

Return to the agreed location on or before the agreed date and time. All rentals counted in 24-hour periods. 59-minute grace period applies.

13.2 Late Returns

13.3 Vehicle Condition on Return

13.4 After-Hours Returns

With prior approval only. $50 after-hours return fee applies. You remain liable for damage discovered at the next staffed inspection.
14. Damage, Loss and Liability

14.1 Your Liability

You are responsible for all damage to or loss of the vehicle during the rental, regardless of fault (including weather, animals, or acts of nature), up to the applicable Excess Amount.

14.2 Damage Not Covered by Standard Excess

  • Tyre damage (punctures, blowouts, kerb damage)
  • Windscreen and all glass damage
  • Underbody damage (chassis, drive train, suspension, steering, exhaust, brakes, fuel tank)
  • Overhead and roof damage
  • Interior damage beyond fair wear and tear
  • Key loss, key damage, or key programming costs
  • Damage from prohibited use (Clause 10)
  • Damage from misfuelling or incorrect fuel type
  • EV battery damage from full depletion or improper charging

14.3 Loss of Use

You may be charged the standard daily rate for each day the vehicle is unavailable during repairs.

14.4 Third Party Liability

Basic third-party liability covered by CTP registration. You are responsible for amounts above statutory coverage.
15. Excess Amounts

💡 Safariway Rentals does not currently offer excess reduction products. Check your own comprehensive motor vehicle insurance before renting.
16. Claims Management Fee
A Claims Management Fee of $150 applies to every damage, loss, or theft claim — regardless of fault — in addition to repair costs, excess amounts, or loss-of-use charges.
ℹ️ This fee is non-refundable even if the claim is resolved without repair costs.
17. Key Loss and Replacement
Keys, fobs, and transponders are your responsibility. Notify Safariway Rentals immediately on 0405 630 231 if lost, damaged, or stolen.

18. Incidents, Accidents and Theft

18.1 What to Do

  • Ensure safety. Call 000 for emergencies.
  • Call Safariway Rentals on 0405 630 231 immediately, regardless of fault.
  • Call SA Police (131 444) if a third party is involved.
  • Collect all party details: names, numbers, registration, insurance.
  • Obtain witness details and take photographs from multiple angles.
  • Do NOT admit fault or make any payment at the scene.
  • Complete a Safariway Rentals Incident Report Form.

18.2 Failure to Report

Failure to report immediately voids all cover. You are personally liable for all resulting costs.

18.3 Theft

Report to SA Police immediately (obtain report number), then call Safariway Rentals. You remain liable for the applicable excess unless theft occurred despite all reasonable security precautions.
19. Mechanical Breakdown Procedure
  • Stop driving as soon as safely possible. Do not continue if warning lights are on.
  • Park safely and activate hazard lights.
  • Call 0405 630 231 (24 hours). Do not restart or continue driving unless directed.
  • Do NOT authorise third-party repairs without prior written approval. Unauthorised repairs will not be reimbursed.
Safariway Rentals is not liable for accommodation, transport, or other costs from breakdown. No charge for genuine vehicle faults.
⚠️ Continuing to drive with warning lights or mechanical problems and causing further damage may result in you being fully liable for that damage.
20. Replacement Vehicle Policy
Safariway Rentals has no obligation to provide a replacement vehicle following an accident, breakdown, prohibited use damage, or rental termination. We may, at our sole discretion, offer a replacement subject to availability where the incident was not renter-caused.
ℹ️ Check your travel insurance or comprehensive motor vehicle insurance for replacement vehicle coverage.
21. One-Way Rentals
One-way rentals require prior written approval and are subject to a relocation fee quoted at booking. Unauthorised one-way returns incur a relocation fee at actual cost, up to $1,000, plus any towing/recovery costs.
22. Tolls, Traffic Infringements and Fines
You are responsible for all tolls, parking fees, infringements, and fines incurred. For notices received after the rental: we transfer to your details as required, charge the full amount to your card, and add a $35 admin fee per notice.

24-hour roadside assistance included. Call 0405 630 231.

Genuine mechanical faults not caused by the renter: no charge.
24. Add-On Extras and Accessories
GPS, child seats, and booster seats available at additional daily charge, subject to availability. Request at booking or before pick-up. Child seat installation is the renter’s responsibility. You are liable for damage to or loss of all accessories during the rental.
25. Loss or Damage to Personal Property
Safariway Rentals accepts no responsibility for loss, theft, or damage of personal property in the vehicle at any time. Items left in returned vehicles held for 14 days; unclaimed items may be disposed of.
26. Limitation of Liability and Australian Consumer Law
To the maximum extent permitted by law, our total liability is limited to the total rental charges paid. We are not liable for indirect or consequential losses, loss of earnings, personal injury not caused by our negligence, or costs arising from Force Majeure Events or vehicle breakdown.
✅ Nothing in these Terms limits or excludes your rights under the Australian Consumer Law (ACL).
27. Termination of the Rental Agreement
We may terminate and demand immediate return without refund if you breach these Terms, use the vehicle for any prohibited purpose, fail to pay, or provide false information. You remain liable for all charges accrued to the date of return.
28. Privacy
Personal information is collected and used per the Australian Privacy Act 1988 (Cth) and our Privacy Policy. We may share your information with payment processors, insurers, law enforcement, and debt recovery agencies. We will not sell your information. 29. Variation of Terms and Force Majeure

29.1 Variation of Terms

We may amend these Terms at any time. Updated Terms will be published at safariwayrentals.au/terms with an effective date. Continued use of our services constitutes acceptance of updated Terms.

29.2 Force Majeure

We are not liable for any failure or delay caused by a Force Majeure Event. We will notify you as soon as practicable and use reasonable endeavours to provide an alternative arrangement or refund.
30. Governing Law, Severability and Dispute Resolution

30.1 Governing Law

Governed by the laws of South Australia, Australia. Exclusive jurisdiction of SA courts and the Federal Court of Australia.

30.2 Severability

If any provision is invalid or unenforceable, it will be severed without affecting the remaining provisions.

30.3 Entire Agreement

These Terms, together with the Rental Agreement and add-on documentation, constitute the entire agreement between the parties.

30.4 Dispute Resolution

Parties agree to good-faith negotiation for 30 days before pursuing mediation or legal proceedings. You may also contact Consumer and Business Services SA or the ACCC.
